Benefits of Mediation
- The time it takes to arrive at a marital settlement agreement is usually far shorter when mediation is used. Your mediation may take one or a few sessions, but there is no waiting period or court calendar to take into consideration. You set your own schedule.
- Cost is certainly one of the most significant benefits for many people. Divorce can be costly, and the longer the process takes, the more costly it becomes.
- You have more control mediating your case because it does not have to go before a judge. You and your spouse can develop a resolution for each issue that is what you choose—not what a judge would choose for you.
- Privacy is much more protected in mediation, because your negotiations are confidential—not a part of the public record. The information you reveal during mediation generally cannot be used against you later in court, and the agreement you reach can cover only facts and areas of dispute that you agree to.
- Solutions arrived at through mediation are usually more acceptable to both parties, because they had a hand in creating the solution. Marital settlement agreements reached through mediation can truly reflect the unique aspects of your family and your culture. This can be particularly important for immigrant families.
- Relationships are often destroyed by the adversarial nature of divorce court. Mediation takes personal relationships into account, and can often help couples understand each other and work together better long-term. This is a significant benefit for couples who have children they will need to parent for years to come.
At the end of a divorce mediation, your agreements will have been documented and paperwork prepared for review by a judge. You may never need to step foot in the courtroom. The judge need only approve your agreement to make it a legally binding court order.
Mediation Is Not Right for Everyone
Even if you would like mediation, if your partner does not agree, this method will not work for you. It is also not a good choice for families that have been impacted by domestic violence or abuse. It will not work well if you or your partner is more interested in fighting than in finding a resolution.
